Undernourished Somalian woman with tuberculosis deported

Administrative Court Frankfurt must check its decision in a oral hearing now
The fundamental question: Where begins and where ends the responsibility of the Federal Republic?

On March 11th, 1999 the 24-years old Somalian woman Safiyo A. has been deported by Lufthansa from Frankfurt to Ethiopia in a piteous health condition. At this time Mrs A. weighted another 31 kg being 165 cm tall. Medical reports confirmed her bad health and nutrition condition and diagnosed a lymph node tuberculosis. But neither the involved authorities nor the competent Administrative Court felt compelled, to stop the deportation at least temporarily. Also the woman doctor in charge diagnosed on the one hand undernutrition and recommended in her medical report a therapy for another 6 months, on the other hand she assessed her to be capable for travelling. That there wouldn’t be any „colleagues continuing the therapy“ mentioned in the dismissal report of the hospital, remained unobserved despite the remark of the woman lawyer…

Almost half a year after this deportation … the question arises (for the judge of the Administrative Court in Frankfurt): How far reaches the protection of the basic right on physical integrity and the protection of the asylum law in the airport procedure? Are German courts and physicians acting in co-operation allowed to deport refugees to their home or third countries, where they don’t have access to medical treatment, abandon them to their fate and possibly expose them to danger of life?
