On the occasion of the 7th anniversary of the ratification of the UN Convention on the Rights of the Child on Easter Monday the Nation-wide Human Rights Association for Refugees PRO ASYL calls upon the Red-Green governmental coalition, to realise their word and promises of the unrestricted implementation of all regulations without reservations.

„The Social Democrats as well as the Greens have supported always and without reservations during the opposition period the demands of PRO ASYL and other human rights organisations for the adaptation of the Aliens and the Asylum Law to the regulations of the Convention on the Rights of the Child and for the withdrawal of the statement made by the Federal Republic of Germany on occasion of the ratification”, said the PRO ASYL-spokesperson Heiko Kauffmann.

Corresponding improvements would be of benefit above all to refugee children. To them the Federal Republic has performed its duty of granting protection only inadequately up to now:

  • Protection of children must be granted according to the Convention (Art. 1) up to the age of 18 years (At the moment refugee children between 16 and 18 years old are treated in the asylum procedure like adults);
  • Unaccompanied minor refugee children should be exempted from the „Third Country Regulation“ and the airport procedure.
  • The special protection needs of all minors just arriving should be taken into account by a special clearing procedure;
  • A child-oriented accommodation, care and promotion should be guaranteed;
    Minor refugee children may not be taken into detention pending deportation.
